Terms and conditions of use

Article 1 - Scope of Application

These Terms and Conditions (hereinafter referred to as "T&C") apply, without restriction or reservation, to all sales concluded by SARL 3DDS (the "Seller") with consumers and non-professional buyers (the "Customers" or the "Customer"), wishing to acquire the products offered for sale on the geek3D.fr website.

Article 3 - Products and Characteristics

The products offered for sale are those listed on the geek3D.fr website, subject to stock availability or production capacities for on-demand 3D printing. The Seller strives to present the characteristics of the products (dimensions, type of resin, finishes) with the greatest precision. Photographs are not contractual. Regarding 3D prints, slight variations (support marks, slight color differences) may exist and are part of the manufacturing process.

Article 4 - Prices

The prices of the products are indicated in Euros, all taxes included (VAT included). Processing, shipping, and delivery costs are billed additionally, under the conditions indicated on the site and calculated prior to the confirmation of the order. The Seller reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of the order confirmation.

Article 5 - Orders

The Customer selects the products they wish to order on the site. The sale will only be considered final after the Seller sends the Customer confirmation of order acceptance by email, and after the Seller receives full payment of the price.

Article 6 - Payment

Payment is due immediately upon ordering. The Customer can pay by credit card or via other secure payment methods offered on the site at the time of the order. Payments are secure, and the Seller never has access to the Customer's confidential banking data.

Article 7 - Right of Withdrawal and Exceptions

7.1. General case (Non-personalized items in stock) In accordance with current legal provisions, the Customer has a period of fourteen (14) days from the receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay a penalty, for the purpose of exchange or refund. Return shipping costs are the responsibility of the Customer.

7.2. Exception for on-demand and custom-made 3D prints Attention: In accordance with Article L221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the "supply of goods made to the consumer's specifications or clearly personalized". Therefore, any order for a figurine or 3D model printed specifically on demand, according to the customer's choices (specific size, choice of resin, personalization, painting) is firm and final. It cannot be subject to any return, exchange, or refund once production has started.

Article 8 - Delivery

The products are delivered to the delivery address indicated by the Customer during the order or to the selected relay point. Delivery times are indicated during the ordering process for informational purposes and depend on stock availability. In the event of low stock or a shortage requiring the re-manufacturing of 3D printed parts, these delivery times may be temporarily extended. In the event of delayed shipping or additional production time, an email will be sent to the Customer to inform them.

Article 9 - Legal Guarantees and Receipt of Products

9.1. Receipt and transport damage The Seller takes special care in packaging 3D prints, which are fragile items. It is the Customer's responsibility to check the condition of the packaging and the product upon delivery. In the event of transport-related damage (crushed package, broken product), the Customer is strongly requested to report it to the Seller within 48 hours following receipt, with supporting photos (to admin@geek3d.fr). This responsiveness is essential to allow the Seller to file a claim with the carrier.

9.2. Legal guarantees Regardless of transport-related reports, all products provided by the Seller automatically and without additional payment benefit from:

The legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code), for products that are apparently defective, damaged, or do not correspond to the order.
The legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), arising from a defect in material, design, or manufacturing.

It is recalled that the guarantee does not cover breakage due to improper handling by the Customer (dropping, exposure to high heat or direct UV rays) after delivery.

Article 10 - Disputes and Applicable Law

These T&C are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts shall have exclusive jurisdiction.
